AN ORDINANCE AMENDING ADA COUNTY CODE, TITLE 8 AS FOLLOWS: SECTION 8-1-4 TO CHANGE THE DATE WHEN APPLICATIONS ARE PROCESSED AND REVIEWED AND DELETE TIME EXTENSION REVIEW TO BE CONSISTENT WITH WHEN ORIGINAL APPLICATION APPROVED; SECTION 8-1A-1 DEFINITIONS TO AMEND THE DEFINITIONS OF MULTI-FAMILY DEVELOPMENT, ALLEY, URBAN PUBLIC FACILITIES, AND TO ADD NEW DEFINITIONS FOR OPEN SPACE DEVELOPED, OPEN SPACE NATURAL, PLANNED COMMUNITY, PLANNED COMMUNITY SUB-AREA COMPREHENSIVE PLAN, PLANNED COMMUNITY IMPLEMENTATION PLAN, ACTIVE AND PASSIVE RECREATIONAL FACILITIES, SELF-SUPPORTING UNIT, TRANSPORTATION DEMAND MANAGEMENT, URBAN PUBLIC SERVICES, AND PROGRAMMED URBAN PUBLIC SERVICE AND FACILITY; SECTION 8-2-1 TO CREATE A PLANNED COMMUNITY BASE DISTRICT; SECTION 8-2A-1 DIRECTING URBAN DENSITY WITHIN URBAN BASE DISTRICTS AND PLANNED COMMUNITY BASE DISTRICT; SECTION 8-2E TO DELETE THE EXISTING ARTICLE E AND ADOPT A NEW ARTICLE E TO ALLOW FOR PLANNED COMMUNITIES WITHIN ADA COUNTY; SECTION 8-3-1 TO CREATE OVERLAY DISTRICTS FOR APPROVED PLANNED COMMUNITIES; SECTION 8-3-2 TO ALLOW ADDITIONAL USES IN PLANNED COMMUNITY OVERLAY DISTRICTS; SECTION 8-3 TO ADD A NEW SECTION 8-3-4 TO ALLOW STANDARDS AND REGULATIONS IN PLANNED COMMUNITY OVERLAY DISTRICTS TO VARY FROM BASE DISTRICT; SECTION 8-3D-4 TO ALLOW BONDING WHEN IMPROVEMENTS CANNOT BE FINISHED BEFORE FINAL PLAT IS SUBMITTED; SECTION 8-3F-9 TO DELETE THE REQUIREMENT THAT APPLICANT FOR VARIANCE TO FLOODPLAIN STANDARDS COMPLETE A PREAPPLICATION CONFERENCE; SECTION 8-6-3 TO DELETE THE REQUIREMENT THAT APPLICANT COMPLETE A PREAPPLICATION CONFERENCE PRIOR TO SUBMITTING SKETCH OR PRELIMINARY PLATS, TO ADD PLATTING REQUIREMENTS FOR PLANNED COMMUNITY PRELIMINARY PLATS; SECTION 8-6-5 TO ADD FINDINGS FOR PLANNED COMMUNITY PRELIMINARY, FINAL PLATS, AND GRADING PERMIT ADDENDA; SECTION 8-6A-5 TO REQUIRE ALLEYS TO BE PUBLIC AND COMPLY WITH ACHD STANDARDS; SECTION 8-6B-3 TO DELETE THE REQUIREMENT THAT THE PLAT BE ACCEPTED WITH REGARD TO STREETS AND OTHER IMPROVEMENTS; SECTION 8-7-2 TO ALLOW DIRECTOR AUTHORITY TO RECEIVE APPLICATIONS, THE DIRECTOR TO ACT ON PLANNED COMMUNITY LANDSCAPE PLANS, PERIODIC REVIEW AND GRADING PERMIT ADDENDA APPLICATION, AND TO ALLOW THE BOARD TO ACT ON AGREEMENTS; SECTION 8-7-3 TO ADD PLANNED COMMUNITY TEXT AMENDMENTS AS A ZONING ORDINANCE AMENDMENT INITIATED BY PROPERTY OWNER, TO ALLOW THE BOARD TO REVERSE A ZONING MAP AMENDMENT AS PERMITTED BY A DEVELOPMENT AGREEMENT, TO REQUIRE THAT ZONING ORDINANCE AMENDMENTS NOT HAVE DEMONSTRABLE ADVERSE IMPACTS, AND TO ALLOW FOR FINDINGS FOR A PLANNED COMMUNITY ZONING ORDINANCE TEXT AMENDMENT; SECTION 8-7-4 TO DELETE THE REQUIREMENT THAT APPLICANTS COMPLETE A PREAPPLICATION CONFERENCE; SECTION 8-7A-2 TO REQUIRE PREAPPLICATION CONFERENCES FOR CERTAIN APPLICATIONS, TO REVISE WHEN AN APPLICATION IS SUBMITTED, AND WHEN HEARINGS ARE SCHEDULED AND FEES REQUIRED, AND DELETING THE 1 YEAR PROHIBITION ON RESUBMITTING SAME APPLICATION; SECTION 8-7A-3 TO REQUIRE THE NEIGHBORHOOD MEETING PRIOR TO SUBMITTAL OF APPLICATION; SECTION 8-7A-6 TO REQUIRE DIRECTOR TO ACT WITHIN 60 DAYS OF SUBMITTAL OF APPLICATION; SECTION 8-7A-7 TO PROVIDE FOR WHEN COMMISSION HEARINGS AND DECISIONS MUST BE HELD OR ISSUED; SECTION 8-7A-8 TO PROVIDE FOR WHEN BOARD HEARINGS MUST BE HELD; SECTION 8-7A-9 TO PROVIDE FOR WHEN HEARING EXAMINER HEARINGS AND DECISIONS MUST BE HELD OR ISSUED; SECTION 8-7C TO DELETE THE EXISTING DEVELOPMENT AGREEMENT PROVISIONS AND ADDING NEW DEVELOPMENT AGREEMENT PROVISIONS FOR THE CREATION, FORM, RECORDING, MODIFICATION, ENFORCEMENT, AND TERMINATION; ADDING A NEW CHAPTER 8 TO PROVIDE FOR REGULATION OF PLANNED COMMUNITIES BY PROVIDING URBAN PUBLIC SERVICE LEVEL STANDARDS, GENERAL STANDARDS, APPLICATION SUBMITTAL STANDARDS, SUB-AREA COMPREHENSIVE PLAN AMENDMENT APPLICATION REQUIREMENTS AND FINDINGS, IMPLEMENTATION PLAN APPLICATION REQUIREMENTS AND FINDINGS, AND ANNEXATION STANDARDS AND FINDINGS FOR ADDING ADDITIONAL LAND TO AN APPROVED PLANNED COMMUNITY.
