Beginning April 1, 2013, if you are using Court Assistance Office forms to file a new divorce or custody case in the Fourth Judicial District, then you should complete a PETITION to start a divorce or custody case in place of a COMPLAINT to comply with the Idaho Rules of Family Law Procedure (“IRFLP”) that became effective in the Fourth Judicial District on January 1, 2013. If you picked up a forms packet from the Ada County Court Assistance Office before March 4^th, or completed a Court Assistance Complaint for Divorce or Complaint for Custody/Support/Paternity from another source, those forms may not comply with the IRFLP. For our office to properly assist you with Court Assistance paperwork your information should be copied into the correct, current Petition form to help you to comply with the IRFLP. You may also need to replace additional forms where current IRFLP Court Assistance forms are available.

If you are completing a divorce or custody case that was filed before January 1, 2013, or if your case was or will be filed in another judicial district, you can find forms to comply with the Idaho Rules of Civil Procedure from the statewide Court Assistance Project website at: www.courtselfhelp.idaho.gov .
