Project Boundary and Unit Area Check

Refer to Boundary and Lot Area Checking for additional information regarding the project boundary and unit closures.

Since a condominium is required to be defined by airspace in three dimensions (length, width and height) it would seem reasonable that the area should be expressed in cubic feet.  The Assessors office is only set up to deal with square feet, which makes the height, or elevation portion of the condominium strictly a definition, instead of a useful component.

Idaho Code 55-1505 (2.b) requires the approximate area of each unit to be described in the declarations.  We normally see the area of each unit used in the calculation of the percentage of ownership interest, instead of using the unit value described in Idaho Code.  Since value is generally directly related to area, we accept either method as long as the relationship is defined.

Idaho State Code does not require the unit areas to be shown on the final plats.

Review

·            The area calculated in the project boundary closure check is compared to the area shown in the Certificate of Owners.  The closure check value must either match, or must round to the value shown in the Certificate of Owners.  Displaying the value to two decimal places is the minimum accepted.  If additional decimal places are shown in the Certificate of Owners, the same criteria apply.

·            If an area table is shown on the face of the plat, the table values are also checked against the calculated values and the Certificate of Owners.  All must match.

·            If areas for each individual unit are shown on the face of the plat, (other than in a table) they are checked against the values calculated for the unit closure.
