Water System Certification

Refer to the Owners Certificate and Water System Certification for additional information.

The certification should be tailored for the condominium project.

The water system certification requirement as written in Idaho Code would seem to only apply to plats that are subject to the terms and requirements of Section 50-1326 through 50-1329, instead of a condominium created under Title 55 Chapter 15.  However, 55-1527 states that “except where inconsistent with the provisions or purposes of this act, state and local laws relating to plats, recording, subdivisions or zoning shall apply to condominiums and to projects as herein defined”  

Review

·        Does the water service certification meet the criteria outlined for subdivision water systems?

·        Does the certification refer to “this condominium project” or “these units” instead of lots, as would appear in a subdivision plat?
