Today the Ada County Prosecutor’s Office filed a new criminal charge against former Senator John McGee today before Magistrate Judge James Cawthon. McGee was charged with a new criminal case for Disturbing the Peace, I.C. 18-6409, allegedly committed on February 7, 2012. The new charge is based on criminal conduct that occurred in the former Senator’s office during the Idaho Legislative 2012 Session.
McGee was also charged with violating his misdemeanor DUI probation by committing the new criminal offense of Disturbing the Peace. McGee had been placed on a one year unsupervised probation which would have expired on July 1, 2012.
Additionally, the Ada County Prosecutor’s Office filed a motion with Magistrate Judge James Cawthon requesting both charges be consolidated for plea and sentencing before Judge Cawthon who presided over the 2011 DUI offense.
Judge Cawthon ordered that McGee be arrested on the probation violation and the new criminal charge for Disturbing the Peace. A $1,000 bond was set on each violation. The next court date will be set after McGee’s arrest.
